When a person is arrested with a charge as serious as first degree murder, that person would be held in prison pending trial; bail would be very unlikely to be granted. The arrested person would obtain a lawyer, either by hiring one or by having one appointed by the court, and then the prosecutor and the defending lawyer would both prepare their cases, and the case would go to trial and there would be a verdict and a sentence. Some jurisdictions have a death penalty, and some do not.
