Depends where you are. In Canada the legal limit is 80 milligrams of alcohol in 100mL of blood. Or 0.08.

Added: Please also note, that while a BAC level above that rate means you are presumed too drunk to drive, a BAC level below that does not necessarily mean that you are not too intoxicated to drive. If you appear to have other signs of intoxication, you may be charged with DUI even if your BAC is below the "legal limit".

Added: (in the US) without knowing what state is being asked about, .08% is the usual amount needed for prima facie. However, you can be cited for "operating under the influence" for amounts of even less BAC - it all depends on your body's tolerance to alcohol and your reaction to it.

It depends on the jurisdiction. Some countries have a limit of 0% others go as high as 0.15%. A few countries do not have a limit. The most frequent levels appear to be 0.05 to 0.08%.If planning on driving while visiting foreign places it is best to check.
