To break the speed limit in order to overtake another vehicle that is travelling at the speed limit, is an offence as you are breaking the speed limit! If the vehicle in front is below the speed limit, you should be able to overtake without breaking the speed limit.

If they are doing the speed limit, there should be no reason to pass them. If you are exceeding the speed limit to pass someone, you could get a ticket particularly if they are exceeding the speed limit.
No, legally speeding is never allowed. The way the police and the law looks at it is if the car in front of you is traveling the speed limit you have no need to pass them. If they are going below the speed limit you can legally pass as long as you do not exceed the posted speed limit. I know what you are thinking. I am going to exceed the speed limit to pass as I want to get around them as quickly as possible but that is a violation of the law. Even though everyone does it.
