This has alot to do with if the impact is on private property and if you had permission to park in the friends driveway, then ultimately if you want to remain friends. If it's an easement or such, the other answers may apply.
Another View: Whether you are on someone else's private property makes no difference, the striking vehicle is At Fault. Your insurance companies will have to battle it out.
it is not the trucks falt because the carstopped behind the truck when they new it was pulling out
both of you for not looking back
Depends on the jurisdiction, but typically, two vehicles backing up is a 50/50.
Hard to say. Possibly equal fault by both parties but most likely the person backing out.
The person backing out. If you were in the lane/road behind them they needed to use caution when backing out.
Backing up--it is your fault.
Clearly, if you hit a stopped vehicle with yours then you are at fault, regardless of whether you were going forward or backward. Similarly, anyone backing up has an obligation to use the utmost care. Here is a fact you should know . Any accident in a parking lot is not covered by any insurance , only wrecks on public roads . Insurers do cover accidents that occur in private parking lots. The police however will not respond nor make a report unless there are injuries. The person who was backing up will most likely be the "at fault" driver
The car that is in motion is ALWAYS at fault.
A backfriend is a secret enemy, or a person who is always behind another in terms of support or backing.
Most of the time this will be a 50/50. If there is Video evedence or a witness that says one or other car was being careless or driving to fast or there is other evedence that could change. One of the things to look at is did the backing car back into the side of the other car or did the backing vehical get hit in the side and how far down the side? If you have evedence of this you might convince the judge and your insurance company who was "At Fault"
You if you were backing up. If you were waiting at a stop sign or stoplight or even an entrance and someone else hit you, it would be the person behind's fault.
Think about this your are backing up, and your neighbors little boy is playing in your yard, and he isn't supposed to be in your yard and you hit him, (a) did you see him? can you hit him because he is not supposed to be there? We are responsible to know what is behind us and be aware of where our car is going. Two wrongs do not make it right. I think you are responsible for hitting a car that is behind you when your are backing up.
yes you are correct. the person backing up is responsible for making sure the area behind their vehicle is clear.
