The question isn't really clear. There are certain VOPs for which a Probation Officer might summons the offender to court for, and have the judge decide what should be done, but if a police agency becomes involved, it is quite likely that you will be arrested and charged with VOP in addition to whatever other offense brought you to the police' attention in the first place.

If you actually complied with the provisions of the house arrest - yes, it would be calculated as part of your probationary period. However - if the reason you were VOP'ed was your failiure to comply with the house arrest order then probably no, it would not.

Yes, if the judge considers it serious enough. It is entirely up to the judge as to what he does with you.

In all likliehood, yes.

Does a probation violation for drug paraphernalia ever go away after time?

This depends on what you mean by go away. If you were arrested for possession of drug paraphernalia while on probation this will always be on your arrest record. If you are referring to being on probation for drug paraphernalia and a probation violation warrant is active then no it will not go away. It is possible to get a lawyer to enter on the case and maybe get Court date without having to be arrested.

How do you violate probation?

Violation of probation means the violation of terms and conditions, standard or special, of probation. It can be anything ranging from staying past curfew to being arrested for a new crime (and a conviction is not necessary for this to happen). Your probation could be revoked or modified. If the former is true you can be sentenced to jail or prison as you would had you not been put on probation.

Probation IS a sentence for being found guilty of an offense. It is at the judge's discretion that they issued a probation sentence rather than sending the convicted defendant to jail.If you violate the judge's trust they may choose to send you to jail to serve the reaminder of your sentence behind bars.

What does it mean when you are arrested for being a fugitive?

If you are arrested for being a fugitive, it means you ran from the law. This can happen if you are on parole or probation and fail to report when you are supposed to. It can also happen if the police are looking for you and you knowingly flee from them.

Is getting arrested an automatic violation?

In Florida, YES. If by violation, you mean probation/parole violation. An arrest means probable existed and that is enough to violate your probation. Also receiving a Notice to Appear which is a criminal citation is also a violation. Any criminal traffic citations such as operating without valid drivers license or driving while suspended/revoked is also a violation. Every contact with the police has the potential to violate your probation because you might be violation of curfew, out of your county, associating with persons engaged in criminal activity, etc. No. Getting arrested simply means you are being detained and notified of possible charges filed against you. Once charges are filed by the local district attorney, you are advised of your rights, interrogated by police, given a bail hearing,(this determines whether or not you sit in jail until your court date), then your court date comes, if I remember correctly.

Is there a difference between parole violation and probation violation?

They ARE similar, however; a 'parole' is a release from jail/prison after you have already completed a certain portion of your sentence behind bars. 'Probation" is a sentence unto itself - you are sentenced to probation without ever having to actually spend any time in jail/prison, based on your promise that you won't re-offend and that you will abide by the terms of the probation. To violate your probation (VOP) could subject you to being incarcerated for the unexpired remainder of your sentence.

I was put on probation for reckless driving. 3 months later i got a marijuana ticket. with marijuana being a traffic violation in mass i was wondering does this violate my probation?

It is possible that the marijuana ticket could be considered a violation of your probation, as it is a separate offense that occurred while you were on probation for reckless driving. It ultimately depends on the specific terms of your probation and the decision of your probation officer or the court. It is important to consult with your probation officer or a legal professional for guidance on how to proceed.

Can they post bail with 3rd degree felony charge He had received probation but had it revoked on recent family disturbance?

Going strictly on the information supplied - - I'm thinking not. Reason being is that when he was arrested his probation was, in all likliehood, automatically revoked. You can't get bailed out from a revocation of probation.
