This exception is what makes such things as pinball machines and those crane machines that grab toys, etc legal. By law, amusement machines can only award the player with the right to replay or with non-cash merchandise prizes with a wholesale value of 10 times the amount of a single play or $5, whichever is less. Prizes can accumulate, however. A Texas court has ruled that gift certificates are the equivalent of cash and this is what gets many gamerooms in trouble. It would be perfectly legal if an operator had machines that complied with the 10x/$5 per play limit that awarded points and the player accumulated points then redeemed them for merchandise such as cigarettes, televisions, etc.
There was a case on Judge Judy where a Texas man claimed to have won a $1,300+ jackpot on an "eight-liner" machine but was denied his winnings (the owner thought the man's cell phone may have caused a malfunction). Apparently Judge Judy was unaware of Texas gambling law and awarded the man a judgment even though this was illegal gambling. (This was obviously illegal because the operator was paying out cash and the machine was awarding more than $5 for a single play.)
