They can because society has no taboos against it. It is a holdover from patriarchal views since men were in power and saw women's breasts in a sexual manner. Women don't objectify men in that matter, and traditionally, they were not in power. So this inequality in how genders are viewed and in who get power would mean that one gender gets a free pass and another gets penalized.
This gets hilarious when transgenderism enters the picture. Non-op transgendered persons who have taken female hormones can typically get by with being topless even on "family" beaches. When the police come, they show them their ID, and the police typically leave. Since they still have male genitals, they also have male IDs. Now, in Tennessee, a transsexual woman thought she could bare her breasts since her ID said male and the state did not ban that for men. But they still arrested her for it, though they used male pronouns in the court documents.
