Are you sure you didn't mean pure comparativenegliegence? If that is what you meant, (i've never heard of 'pure negligence' certainly doesn't mean there arent' any I just haven't heard of that). This is how 'pure comparative' works. Any combination of 100 can be assessed 'At Fault' and each party pays that full percentage to the other, such as: You are deemed 10% at fault other driver is 90% at fault, your insurance company will pay other driver 10% of their damages, and other drivers insurance will pay you 90% of your damage.....40/60-1/99-50/50, any combination of 100 is paid that amount...comparative with 50% rule is you must be LESS than 50% at fault to recover damages, ie, you are 50/50 neither party collects from the other, but you are 49% they are 51% you get the 51% of your damage, and they are barred from recovery from you because they were 50% or more at fault...clear as mud huh? Each state has it's own neligence law.......

pure pure
Unless you sue in a contributory negligence state (meaning if the plaintiff was in any way at fault they are not entitled to relief), an unlicensed driver may sue the other party for negligence. Depending again on the state you are suing in and if they are a pure comparative negligence (ny) or modified comparative negligence (nj) your relief will possibly be reduced by your amount of fault. If in a modified comparative negligence state, if you are more than 50% at fault you are barred from recovery.
The least serious degree of negligence is "ordinary" negligence. The most serious is "gross" negligence.
