It is almost impossible to cause a mental illness in another person. An act that could cause mental illness would almost certainly be a crime and actionable tort in and of itself, but the fact that the victim develops mental illness in response does not make it a crime or a tort. For example, a person may cause another person to develop PTSD by kidnapping the victim and subjecting him to severe physical abuse. The kidnapping and battery are crimes and torts and would be actionable. The victim's PTSD would be considered a mitigating factor, and may be used to increase the financial liability or the jail term.
