You will more than likely have Children's Services called on you and there will be an investigation. You could have your children removed from your home or you could be accused of child endangerment.
Unless you are the mother or father of this child, the easiest way would be to make a report with Child Protective Services, who would evaluate the mother's home, if your accusations are founded, and can make a recommendation for a change in custody to the court.

Still, barely enough information but I'll give it a try.... If by taking HER son home it meant leaving YOUR child alone in the house, then what she did was probably lawful. If she had taken her son (your step-son) and left your young child alone and un-supervised in the house, she would have been liable for 'Child Endangerment' (for knowingly leaving a child home alone). Kidnapping is a criminal offense and must be done with a CRIMINAL INTENT. If her INTENT was not criminal, then there was no crime.
