Yes, if you have used a R4 card in your 3DS and you connect to wifi with it nintendo would see that and they can brick you system, brick means that they can block your 3DS example: you used an R4 and then you connected to a wifi, nintendo saw it and they bricked your 3DS, in the start you cant notice it but after you shut down your 3DS you cant open it anymore. but thats only for the 3DS and DSi, for the DS and DS lite R4 cant do anything. r4 card is 100% safe for your console. It will simulate the original cartridge to work on the system. the console won't recongize it.
