First, being a mother is irrelevant, because having a child does not emancipate a person. In Florida, at 16, a petition for emancipation can be filed with the court. In order for emancipation to be granted you would have to prove, among other things, that you are capable of fully supporting yourself and your child (rent, utilities, food, etc) *without any assistance* (note: they would likely consider child support to be legitimate income and not a form of assistance). Most likely, the judge would also require that you remain in school. You would have to convince the court that it's truly in your best interest to be emancipated. That means you must have legitimate, valid reasons. Just not getting along with your parents or wanting more freedom is not going to be enough. Florida like most states that have emancipation laws has stringent requirements. The state law pertaining to early emancipation is titled "Removal of The Disabilities of Non-Age" (Chapter 743). The minor must be at least 16 years of age, and (paraphrasing) the emancipation petitionmust be filed by the minor's natural parent(s) or legal guardian, if there is no such person, it must be filed by a Guardian Ad Litem (court appointed legal representative).
