The code of Hammurabi simply states that it shall be an "eye for an eye." For example, if someone were to burn down my theoretical house, the code of Hammurabi would then state that their theoretical house would have to be burnt down. The two main imperfections then being that it doesn't take accidents into account, and that an eye for an eye leads to everyone being blind. There is no statement specifically stating who has to do the burning of the theoretical house.
