What the cops have to say to you when you are arrested?

You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to a attorney present during questioning. If you cannot afford a attorney, one will be appointed to you.

Police can do many things when they pull you over and it all depends on the reason. Most traffic stops are for traffic violations, but police don't know if you just committed a bank robbery in the next county and have sworn never to go back to prison. Police will approach your vehicle cautiously, but without their weapons drawn. They will ask for you driver's license and any other documents that the law allows them to ask for. They may explain why you were pulled over, or may not explain unless you ask. Then they may write you a ticket, a warning, or give you a verbal warning. Before the ticket is written, however, they may check to see if you, or the car you are in, is wanted by other police officers in a warrant. If you have a warrant, they will ask you to step out of the car and they will handcuff you and search you.

If the police stop you for bank robbery, then they will pull their firearms out and may command you to get out of the car. Follow their instructions carefully as they may believe you are armed. You may be handcuffed until they determine that you are not the person(s) they are looking for. They may search you and your car for weapons and evidence of the robbery.

For less serious offenses, their response will be somewhere between these two options. Be careful to follow their orders.

In any situation where you have been pulled over by the police, do not:

1) Get out of the vehicle unless ordered by police.

2) Do not argue about the stop, the ticket, or anything else. The Court is the proper place to argue the officer did something wrong.

3) Call the officer names or curse at him/her. This might result in an increase in the charges on the ticket or increased penalties if you are convicted.
