After 1759 Canadian Laws were determined by the British who allowed the French to retain much of their legal system. The administration of these laws and creation of new laws were slowly being transferred to citizens of Canada until 1926 when the Balfour declaration clearly gave Canadians all the ability and responsibility for their own laws and policies.
In 1982 all remaining ties to Britain for creating laws and policies were official severed. For the most part Canada determined their own laws though they are now heavily influenced by their ties to the USA who in many cases enforce American law within Canada.
This trend is increasing with Canada transferring or "sharing" responsibility of policing and defending Canadian borders.

Why was the family compact so powerful in upper Canada?
Because they were rich. They were rich because they came from the right families. This history has Canadians believing that a Canadians status should not be determined by their family or race. Which is why so many Canadians do not agree with the special status of "founding peoples" or laws or treaties that give people special status based on family and race. Of course the rulers of Canada are for the most part rulers and wealthy because of their race and special family status. They fully support laws that give special status and access to Canadian resources based on race and family, so no change any time soon.
