Under the Constitution you have a right to face your accuser in court. If the officer does not show up to give testimony and is not available for cross-examination the case should be thrown out. Some state, the Judge will take the bench and need to hear your story. No cross-examination need. This is true in Virginia.

A judge might dismiss the ticket for an officer not showing up to the hearing. He also can place a mark against the cop then reschedule the hearing. During the second hearing, the judge dismisses the ticket if the cop does not appear.

More often than not, the court will give the prosecutor one adjournment, even though it is his obligation to be ready for the trial on the trial date. And that means having all witnesses ready. A stricter judge might dismiss the ticket for the state's failure to be ready, but this is not usually done. In any event you should be sure to ask the court to dismiss it. When the judge denies the request, you may have an appealable issue. Courts are a bit understanding about witnesses not showing up when they are supposed to. It happens to defendants too, and courts don't make them proceed without a witness for their defense, at least on the first trial date.

Contact the Clerk of The Court's Office ASAP. They will advise you what occurred. You may have been found guilty and fined 'in absentia' and/or (what's more important) it is possible that your license was suspended for failing to appear.
