Can you hold back money if a subcontractor doesnt have insurance?

If the contractor has already finished the work you can not legally hold back his money. What on earth would you be holding it for anyway? Most states in the U.S do not require a contractor to be insured so you would have no legal grounds and are subject to suit by the contractor. If your upset that he didn't have insurance, You were supposed to check that before you hired the contractor in the first place. Holding the contractors money after the job is completed just looks like your trying to cheat the contractor out of his pay. If the contractor wants to, he can sue you and or place a lien on your house if you fail to pay.

Would a commercial policy cover losses due to inability to oversee work if a contractor became terminally ill while working on an addition?

More than likely the contractor's insurance policy would not respond as his inability to complete the job is not a covered cause of loss on his liability form. There is a way to protect this exposure, however. Prior to awarding a contract to perform work by a contractor you can require a performance and payment bond. The insurance company will pay the money necessary to hire an alternative contractor(s) in his place to guarantee that the job will be completed. It is important to note, however, that a bond does not work the same way as a traditional liability policy. Where a traditional liability policy will indemnify the injured party subject to any applicable deductibles, a perfomance and payment bond requires the bonded entity to indemnify the insurer once they have met their obligation to the party holding the bond. In other words, the contractor will have to pay back the bond company any money paid to to insure the job is completed. This requires stringent underwriting and the disclosure of much financial information and the contractor's work load, often times requiring the contractor and spouse to individually indemnify the insurance company.

What do you do with mail that is not address to you?

You can give the mail to the correctly addressed person if they live nearby or that is something you can do, or you could take it back to the postal office or politely put a note on the letter and say that it was incorrectly delievered and needs to be redelivered to the correct address and put it in a mail box for a postal carrier to find.

How do you polish vinyl railings?

I was told a few years back by my contractor who wrapped my house in vinyl and albumin columns to keep them from having a chalky finish after being weathered, wash with a liquid dish detergent with harsh lemons and orange extracts. Then apply a coat of Turtle wax. This will allow the finish to stay clean and shiny like new.

What do you do if the pool company installed your Hayward sand filter and it is not level?

Call them back to do the job correctly. There should be no extra charges for correcting bad labor and installation. Was this pool company licensed as a contractor? If he won't correct the problem - report him to the contractors license board in your area. K

Can a contractor legally take back material installed on a homeowners home when they refuse to pay?

No. "Self-help" is not appropriate here. The contractor should file a suit for the balance owed. Sometimes the contractor is able to put a lien on the property to ensure that they will get paid.

If a job performed by a contractor is poor quality and or not finished and you withhold a percentage of the payment to compensate can the contractor put a lien on your house?

Yes. But the contractor could be sued for slander of land title, and would have to pay court costs and attorneys' fees (if you prevail in court after a lawsuit) (in WA). Since I am a construction law expert, I will lend this advise: if the work is not finished or unsatisfactory, DO NOT PAY THE CONTRACTOR ANY MORE MONEY.Instead, write him a letter describing the unfinished or shoddy work and give a certain time period (say, 10 days) to come and fix the defective workmanship. Odds are, the contractor won't do anything, in which case you're free to hire a very good contractor to finish the job. Then, the shoddy contractor may file a lien against your property (just because he can file a lien doesn't mean the lien has merit). Once the contractor has filed the lien, unless you're selling or refinancing right away, or want to "get back at" the contractor immediately, I would do nothing and wait until the contractor sued me for foreclosure of the lien (note the time period to foreclose a lien in WA is 8 months). At that time, I would retain a good construction law attorney and counterclaim for slander of title (filing a lien with no merit) and breach of contract (since you had to pay the other contractor to finish the work) with a prayer for attorneys' fees (RCW 60.08.080). In the event the time lapsed for the contractor to foreclose the lien, or if no lien is filed, you will want to see a construction law or real estate attorney to sue the contractor (look in the phone book for an attorney who will give "free consultations").
