Romeo was at the point married to Juliet, which is Tybalts cousin. therefore romeo did not want to kill Tybalt for Juliet's sake.

The prince doesn't sentence Romeo to death because: 1) If Romeo didn't kill Tybalt, he would've been executed anyway 2) Tybalt would've killed Romeo if Mercutio hadn't stepped in. Mercutio died because Tybalt killed him, and Tybalt died because Romeo killed him. 3) Tybalt paid the price for killing Mercutio, and when the prince asked who would "pay" for Mercutio's death, Montague said Romeo shouldn't have to because they were good friends, and Romeo killed Tybalt to avenge Mercutio.
In the fight between mercuito and Tybalt: Tybalt comes into the court place and mercutio starts egging him on. Pretty soon they start fighting but its not a serious fight. Tybalt is really waiting to kill romeo because he is mad at him for going to the capulets party. Then romeo shows up and he doesnt want to kill Tybalt bc he is now married to Juliet and they are technicaly cousins. Tybalt doesnt know this and he is still fighting mercutio. Then romeo interferes to stop the fight but Tybalt accidentaly stabs mercutio when romeo gets in the way which kills mercutio. Then romeo goes to avenge mercutio and he ends of stabbing Tybalt, who then dies. Then romeo is banished to mantua by the prince.

It incites Romeo into killing Tybalt. The death of Tybalt not only get Romeo banished but makes it very unlikely that Lady Capulet will ever accept his marriage to Juliet. She would certainly have Romeo killed if she knew (she is planning to kill him anyway).

Romeo initially wanted the fight not to happen, as he had already been wedded to Juliet and did not want to get on Tybalt's bad side, let alone fight him, which would only amplify any hatred between them. However, when Mercutio and Tybalt, both hot-headed and easy to aggravate, started to fight, and Mercutio died under Tybalt's blade, Romeo felt taking his best friend's side as his first priority. He fought with Tybalt out of rage of him killing Mercutio and ended up killing him. simple answer: Mercutio's death by Tybalt spurred Romeo to kill him
