Romeo was at the point married to Juliet, which is Tybalts cousin. therefore romeo did not want to kill Tybalt for Juliet's sake.
Romeo kills him first.
With a sword
Romeo had to kill someone, in order for the sequence of events to happen properly. Tybalt has been set up as a quarrelsome man who imagines that he has a grudge against Romeo for crashing Capulet's party (Capulet didn't seem to mind) and so will inevitably create a fight, which creates the occasion for Romeo to kill him.

Romeo picks a fight with Tybalt in Shakespeare's play "Romeo and Juliet" after Tybalt insults him and his friends at a party. Tybalt challenges Romeo to a duel, but Romeo refuses to fight. This leads to Mercutio, Romeo's friend, stepping in and fighting Tybalt instead, resulting in tragic consequences.
At first, Romeo does not want to fight with Tybalt because he is now married to his kinswoman, Juliet. This makes Romeo and Tybalt of the same family, and Romeo does not want to fight his own.
Tybalt wanted to kill Romeo because he felt that Romeo disrespected his family and their feud by attending the Capulet's party. Tybalt was a passionate and hot-headed character who believed that harming Romeo would be a way to uphold the honor of the Capulet family.
mercutio didnt kill Tybalt, Tybalt killed merctio and then romeo killed Tybalt.=D
