Yes, he is. In Sophocles's Oedipus Rex Oedipus kills a man, quite irrationally, whilst traveling in a convoy. This man is later revealed to be his father, King Laius of Thebes a man Oedipus didn't know due to his abandonment as a child. One possible mitigating circumstance is that Oedipus' killing of Laius was prophesied by an oracle - this is why Oedipus is abandoned at birth. It may be argued that the prophecy destroys Oedipus's free will, and hat he is therefore culpable, but not guilty. But in the simplest of terms, yes, Oedipus is guilty of his Fathers murder.

Anything is possible if he can find an attorney who will take his case to Appeals Court. But usually - no - you can't He has already been sentenced for that crime and begun serving his penalty. Probation WAS his sentence/penalty. After you plead AND begin your sentence you can't go back later and decide you didn't like the sentence you got.
It can be done as soon as guilty verdict is announced, or set off for a later date at a sentencing hearing.

Unless you have proof you are not guilty the judge will still find you guilty. Why not just take responsibility for your actions if you are guilty.
Not quite sure what the questioner is asking, but I'll give it a try. If you choose to plead guilty to a state criminal offense, you will not go on trial, however you will attend a sentencing hearing at which the term of your sentence will be announced. If you plead NOT guilty to a state criminal offense, you can choose to be tried by a judge, alone, or by a jury. After hearing all the evidence, both against you and in your favor, the judge and/or jury will make a decision which the judge will announce. If you're found guilty, later on (or some cases immediately) the sentencing hearing will be conducted, and your sentence announced.

Not at the moment, perhaps I will have time later.
You need to write the story first, and worry about the first sentence after you've got the whole thing down! Just start writing and come back to change your first sentence later if you want to make it more interesting!
