Now, a nonpublic, privately held charity or association like the Boy Scouts and the Girls Scouts can be gender specific in who can be in there troops. They can keep girls out of the boy scouts and they can keep boys out of the girl scouts. They cannot however discriminate based on race, religion, etc. They can however insist on not having child molesters in their leadership or people they feel may be of bad influence on the children. They can also obviously say that a 33 year old cannot be a kid scout but he or she can be an adult scout leader. Associations like the Red Cross must allow any one to serve in the Red Cross unless they have a criminal background.
