If a guy pays child support and picks his son up and decides not to take him back is that kidnapping?

Yes. That may be considered parental kidnapping. The father may find himself in a peck of trouble if he violates an outstanding custody order. In the end he may lose his visitation rights. It's a bad idea that will cause more harm than good.

A child need a stable home. If the mother have provided this for a long time alone, then that is where the child lives. A father can not decide against that without a very solid reason and go to court over it..

If this is done in order to prevent damage to the child, then you should keep child away, but at the same time you so chooses, go to the police or authorities and explain the reason for not giving your son/daughter back. If they do not see the problem you describe, then you must give back the child. Failing to do so will most likely prevent you from seing your child for a while.

The mother can however turn over custody to a father if she so chooses.

Implications from law may arise.

Answer:

Unless you are the heir to a multimillion dollar empire, or your parent is a political office holder, or your kidnapper knows you, the odds of you being kidnapped in the US are about the same as being struck by lightning or being attacked by a shark (slightly better than the odds of winning a lottery jackpot). The truth is kidnapping just does not happen that often. Most people automatically take the precautions they need to take to prevent it. That is not to say you should just let your guard down; there are people out there who would do other than attempt to kidnap you.

If you are attacked, and you are able to get away, do it. Run! always. While you are running, scream. Don't scream "Rape," don't scream, "He's after me." Scream "FIRE!" People will always run to see a fire.

If your attacker has a weapon, do what you can to stay away from him/her. Human behavior dictates that the gun that is seen is less of a danger than the one that isn't, and the knife that is seen is far more dangerous than the one that isn't. Don't try to fight back if your attacker has a weapon. DO try to get away. A knife is only effective at arms reach, and most people could not hit the broad side of a barn from the inside with a hand gun especially if that barn is moving away from them rapidly and screaming, "FIRE!" Even if you were to by some convergence of chance get hit by a bullet, you are likely to survive, keep running until you can get to a public place...a bar, convenience store, gas station. And, when you get there, keep screaming...the more hysterical the better--people are more likely to try to help you if you are hysterical. Seems weird, maybe, but it is how humans behave. Besides, the shock may keep you alive.

Remember, fear is your friend, awareness is your companion. Use them both effectively.

If step-son is sitting your child and his mother takes your child from your home wo consent bc she didn't agree son should sit while dad step-mom went w friends to bar grill is that kidnapping?

Still, barely enough information but I'll give it a try.... If by taking HER son home it meant leaving YOUR child alone in the house, then what she did was probably lawful. If she had taken her son (your step-son) and left your young child alone and un-supervised in the house, she would have been liable for 'Child Endangerment' (for knowingly leaving a child home alone). Kidnapping is a criminal offense and must be done with a CRIMINAL INTENT. If her INTENT was not criminal, then there was no crime.

What did Mr Lindbergh do after the kidnapping and did he shoot his own child?

Tragic as it sounds, one cannot rule out Colonel Lindbergh ( as he was) as a possible suspect. He was seen storming around the grounds of his estate (this was not in hunting season) toting an Army-issue .30-06 Springfield. The crime happened very abruptly with no direct witnesses. one cannot help thinking.

Did the kidnapping of Steven Stayner contribute to Cary Stayners murders?

I doubt that it helped the situation any. The Stayners were semi-dysfunctional as a family. Things were not talked about and dealt with like they maybe should have. When Steven Stayner went missing it put a tremendous strain on this family, like it would any family. I think for Cary Stayner the reappearance of Steven 7 years later was almost as traumatic. The family was in upheaval and even with the return of Steven the family never sought any kind of emotional help.

The kidnapping by itself did not turn Cary Stayner into the serial killer that he became, but it was probably a contributing factor in an already disturbed mind.
