The formaldehyde smell is usually from outgassing from formaldehyde used in the manufacture of some of the materials used to line the safe- foam padding, carpeting, etc. The smell SHOULD go away with some ventilation for a while. Do not know the date of your question (part of a pile of older questions that the computer dredged up) but it is now 2012- a safe bought 3 years ago should not be outgassing at this time. Would try leaving the door open with a small fan blowing into the safe for a few days, and see if that fixes the matter.

No. If the firearm is in the same residence in which you live you are in "constructive possession" of it. It makes no difference where it is kept. PERIOD! No one is going to believe that you don't have access to it, especially if you are in a "relationship" with the owner of the gun, who just happens to live with you.
