yes and no, at first the penguin probably could fly and swim but swimming provided a better survival tool and natural selection did the rest and after flying became obsolete THEN the penguin likely became less and less suited to flying and most likely gained wait in blubber to protect it from the cold making it even less likely for a penguin to fly .

No. Their inability to fly actually stems from a behind the back deal of other, flying birds and the seals, sea lions and orcas of the world. In exchange for not allowing the penguins to fly, the predators would eat the penguins and not the other birds.

Penguins never saw it coming.
