In most states yes, if the child is using the phone inappropriately. For example, the big thing today is texting other students, playing games instead of doing school work, etc. Typically the school will call in the parent, explain what happened, and give the phone to the parent with a warning. Personally my children took cell phones to school with the understanding it was only to be used in case of an emergency. If they broke that rule, they would face my wrath, and as a former Marine I had a lot of that!
No the teacher is not allowed to physically snatch the phone out of your hand in some states this is considered simple assault. The teacher is however allowed to ask you to hand over your phone for confiscation til the end of the day or otherwise noted on the school policies.

Hats should be allowed in school. It is not such a big deal seeing how the teacher has complete control over taking it away if it is a problem. I believe that they should be aloud if the teacher gives them 1 chance to have them.
