Answer: The law does not recognize the category of "fake" threat - athreat is a threat.. Like robbing a store with a "fake" gun, the crime is increased to armed robbery with a much stiffer penalty whether the gun is real or fake. Sitting in remand until they get to your case, even for a few hours, walking on waste covered floors in your socks with a crowd of unpleasant folks can seem to be a long time. Jail may not be in the offering, but the alternative of juvenile detention centers is not much fun either. Then again, if the judge or prosecutor feel you may be a danger due to mental problems, you may be in for a psych evaluation - again a crowd of folks that are hard to deal with. On the down side, unless you get an absolute discharge, you may have a trail of paper that will keep you out of any job requiring being bonded or getting security clearnace for the rest of your life
