Yes it should be and it should be prohibited by law too.

In the US, even offensive music is protected by First Amendment to our Bill of Rights. Objectionable material can be limited to where it is not a nuisance to the public, by the Declaration of Independence that says "...unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness". The pursuit of happiness has been interpreted to mean that one person can't impinge on others basic comfort.

In other words, you have the right to say what you like but you can't force others to listen to it. You can restrict it where the general population of that place would not like it, such as schools, hospitals, shopping mall, trains, public streets, etc.
