It really depends on you. If this is your child and you would like to make sure you know where he is at all times in case something happens to him then by all means buy them a cell phone, but only if you believe it's necessary to make sure the child is safe. A Go phone would be good since it's cheap and it only includes 911 ( or whatever the local authority's number may be where you live ) and any other number you want.
It all depends on the kid. If they're responsible and will not leave it at a restaurant or something like that, then 9 is an ok age for a cell-phone. Get a cheap mp3 player and see what happens to it. If they still have it in 1 month, then they are responsible enough for a phone.
Also remember there are cell phones for kids, that allow them to be tracked, even if the phone is turned off, they are still able to be tracked. So to me, cell phones for kids is a great idea, not for the convenience, but for the safety of our children.

If it is legal for schools to keep a cell phone for 9 weeks would depend upon what their code of conduct rules say. Most schools will not keep a phone for this long.
As young as (in my opinion) 10 or maybe 9 years old... I got mine for elementary grad. I think after elementary school kids need cell phones because thats wheen they hang out with their friends more often, they stay home lone.. Etc
