As far as I know, when you are on disability your are to return to your employer with either the same or similar position. They can give away your position, but you are allowed back onto the job with a similar or same position. For example, you stock shelves in a store in Dept A. making $$ an hour. You go on disability and they put another person in your spot. When you return to work after being on disability your employer is obligated to have you stock shelves as before at $$ per hour, but it may be in a Dept B.
I hope that makes sense. I would fill out the FMLA form because that protects you.
Question 1 Can you be fired if you are on disability due to a medical condition like cancer by your employer? Question 2 Can your employer fire you while on a medical disability over 6 months
Alcoholism is considered a disability under the law in the US and Canada. You can be fired for behavior while under the influence, but not for being an alcoholic.
That depends on what you are being fired for, if you are being fired for being out of work, that is illegal, if however your employer were to fire you for reasons unrelated to the medical leave, that could be legal depending on the reasons.
In Texas, a teacher cannot be legally fired solely for being on disability due to an organ transplant, as this may constitute discrimination under the Americans with Disabilities Act (ADA) and other related laws. However, if the teacher's absence impacts their ability to fulfill job responsibilities and the school district has followed proper procedures, termination could be a possibility. It's essential for the teacher to be aware of their rights and to seek legal advice if they feel they are being unfairly targeted while on disability.
If you were fired because of mental illness, then you should collect disability insurance, rather than unemployment insurance, and it lasts much longer.
Legally, yes, but it may be a factor in whether you're approved for Social Security Disability (SSDI).While the Social Security Administration doesn't prohibit people on (SSDI) disability from receiving unemployment checks, state unemployment regulations usually require all unemployment recipients to be willing and able to accept full-time work. This creates a conflict, because you're generally not eligible for Social Security disability benefits if you're capable of full-time work. For more information, see Related Questions, below.
People are not "hired under" the ADA. The ADA merely prohibits discrimination by employers against covered individuals and requires employers to make reasonable accommodations for covered employees. A covered individual can be fired as long as the employer's action did not discriminate against the employee on the basis of his or her disability. For example, any employee, covered or not, can be terminated for cause.
No. It's possible to buy Disablity Coverage while employed, then get disabled while unemployed. There are many types of Disability Coverage.... State Disability, Social Security Disability, Private Individual, etc.
I believe there are ways to make additional income when on disability. You will have to find out the maximum amount your allowed to make while on disability. You are permitted to make up to a certain amount in addition to the amount disability pays you.
If you did something stupid, you can be fired. Going on disability or Workmen's Comp does not pardon you from the ramifications of committing a terminable offense
Yes. If you are collecting disability insurance then you cannot work.
You can be fired for asking another Employee to clock you in while being in the parking lot.
