Palko v. Connecticut 1937 was an attempt to prevent double jeopardy on the state level. In this case, it was decided that a man who had been convicted of second degree murder and sentenced to life in prison could then later be tried for the same crime, convicted of first-degree murder, and sentenced to death.

Palko v. Connecticut was overruled by Benton v. Maryland in 1969.
