The HOA should have rules. Very much like an apartment building. And there should be a "due process" procedure where if someone is accused of violation of the rules, they are given a chance to "make good", and if not, then in most jurisdictions associations have powers similar to a landlord that could include evicting whoever lives there (owners or tenants .....) even if the owners are the ones in violation. You need to check your state laws, condo or townhome declarations and rules, with your management company if any, and outside counsel -- associations should almost NEVER do things on their own like this, and some states prohibit associations from doing so.
