In Chaplinsky v New Hampshire, 315 U.S. 568 (1942) the United States Supreme Court upheld the conviction of Walter Chaplinsky for verbally attacking a police officer. Chaplinsky had been engaging in 'sidewalk' preaching and got a little too loud causing a commotion. He was removed to the police station by the policeman. Along the way to the police station they met a marshall who had warned Chaplinsky earlier in the day and Chaplinsky attacked the Marshall verbally. He was arrested for intentionally directing offensive language at another person in public. He was found guilty and appealed his arrest.
The Court was unanimous in upholding the arrest. In the decision the Court held that certain categories of speech such as obscene, libelous, profane or 'fighting words' were not protected by the First Amendment.
