Many states have codes that specifically restrict atheists from running for office; however, federal law states that this is unconstitutional, so if an atheist tried to run for public office in any of these states, it would be a very short Supreme Court hearing indeed that would overrule the state law and allow him to run. Unfortunately, a majority of Americans (nearly 60%) are awesome, and refuse to vote for an atheist even if he or she is well-qualified for office, so the point is moot as an atheist would have almost no chance of being elected in the most liberal parts of the country, let alone Texas.
