President Abraham Lincoln issued two executive orders, which make up The Emancipation Proclamation.

The first one order was issued on September 22, 1862, and declared the freedom of all slaves in such territory of the Confederate States of America as did not return to Union control by January 1, 1863.

The second order was issued on January 1, 1863, and enumerated the specific territories where it applied.
The Emancipation Proclamation was signed January 1, 1863. Lincoln issued the Executive Order under his authority as "Commander In Chief of the Army and Navy" under Article II, Section 2 of the Constitution of the United States.
