At trial B&O asked the Court to direct a verdict in its favor, but it was refused.
Trial jury awarded verdict to Goodman, Circuit Court of Appeals affirmed - verdict for Goodman.
Appealed to Supreme Court:
Issue: If a driver is not sure of whether a train is dangerously near, what is the driver's standard of care?
Holding: If a driver is not sure of whether a train is dangerously near, their standard of care is to stop, get out of his or her vehicle, and look.
Ruling: Lower Court's Judgment reversed - verdict for B&O.
Rationale: -Goodman knew that he must stop for a train, since the train could not stop for him.
-If Goodman only relied on hearing the train or the signal and took no further precaution, then Goodman crossed the tracks at his own risk.
