Clement Vallandigham was a two-term congressman, 1859-1862, who believed states had the right to have pass their laws and could secede if the federal government interfered. He did not believe in war to maintain the union. After he has defeated for a third term, he became a spokesman against the war and the leader of the Copperheads. As result of his anti-war activities he was deported to the South under the War-Powers Act. The act was challenged in court but his deportation was upheld. Lincoln did have the authority under the laws at that time to banish him.
