The process for amending the Constitution is extraordinarily difficult. This can actually be seen by just looking at how many amendments there have been. Excluding the first 10 which were included in the Constitution, there have been 17 amendments since the ratification of the constitution in 1789.

To pass an amendment, you must have a 2/3's majority for it in both the Senate and the House of Representatives in Congress, and then a you must get 3/4's state approval.

Formally amending the constitution is definitely NOT easy. There are 2 methods of amending it:

The first method is for the proposal to pass through BOTH Houses with a two-thirds majority. Once this is done, it goes to the states. Presently this method is the one taken by all amendments. As it is difficult for two-thirds of ALL Congress-people to agree on the terms of a proposed amendment, very few of them pass to the states.

The second method is for a Constitutional Convention to be called by two-thirds of the state legislatures. This convention will then propose one or more amendments, sent to the states. It must be approved by at least three-quarters of the state conventions to pass. This method has NEVER been used, and debate is ongoing pertaining to its use and impacts.

Regardless of which path is taken, assuming the proposal has been passed, the amendment must then be ratified, or approved, by three quarters of the states. There are also two ways to do this. The text of the amendment may specify the bill being passed by legislature or convention, although they are sent to the legislature by default. Here, they only require a simple majority (more than half) for passage, and thus successful amendment.

In other words, an amendment needs 2/3 of all Congresspeople and AT LEAST HALF of the states (method 2 requires at least 3/4 of the 2/3 of the states to agree, remember?) agreeing upon the terms to be passed.

Given the extremely partisan nature of Congress, there will rarely be an instance of one-sided support. With members frequently disagreeing upon the most trivial of minutiae, an amendment, even if useful, is often 'killed' by political squabble. Thus, amending the constitution- in any country, not just America- is extremely hard.
