Everyone assumed it was constitutional for years - slave-states one side of the line, and free soil the other. But then in 1857, in the Dred Scott case, the Supreme Court said that slavery was protected by the constitution.
This appeared to mean that the new territories could not vote to join the USA as free soil, and could even have meant that slavery was legal in every state in the Union.
