Why is The Bill of Rights not in US Constitution?

They were really busy trying to get the /rest/ of the Constitution ratified, although it hadn't slipped their minds. As Alexander Hamilton wrote in Federalist No. 84, a Bill of Rights was unnecessary as it might be perceived as the ONLY rights that people had, when in reality they had much more. A lot of them, like Hamilton, worried that a Bill of Rights would be more trouble than it was worth.

But the writers of the Federalist Papers (Alexander Hamilton, James Madison, John Jay), and other supporters gave in to a Bill of Rights. If you just let this Constitution pass, they said, we'll work on a Bill of Rights. But it was the fear expressed in No. 84 that led to the 9th amendment, among other things.

The original authors of the Constitution were already working hard to replace the Articles of Confederation with a better system. They had to convince 13 separate State governments to ratify the exact same document and toss the Articles in favor of the new Constitution. This was hard enough without adding the Bill of Rights to it initially. However, it didn't take long for the leading politicians and statemen of the time to realize they needed to ensure civil liberties were included in the Constitution, so they drafted and eventually got the first ten amendments to the Constitution passed after the Constitution was accepted.

The Constitution as written was having trouble being ratified by the states until it was clearly spelled out as to exactly what rights were granted and by whom. Also the Constitution mostly deals with how the federal government is established and run, not what powers it is given, thus the Bill of Rights spells out what rights of the common man (individually) has that the government was supposed to be unable to infringe. In essence, protecting "us" from "them".
