No! not fake. Some people would call them copies but definitely not fakes. They are heavily based on more expensive models (i.e. Fender Stratocaster) but they are a lot cheaper. They say "Encore" on the headstock not " Fender". Therefore clearly stating ""THIS IS NOT A FENDER""
The quality of the guitar will be way below its more expensive cousin, but then it is aimed at student's not seasoned players. I have never played one so I couldn't say with any authority how suited or unsuited they are for this. But I think most teachers would tell you very cheap Guitars tend to be harder to play due to such things as string height being too high making it to get a nice firm contact with the fret board when you try to press down on a string.
Encore are not the only guitar manufacturer to base there guitars on more famous models and some of these are just as expensive as the brands that inspire them

It is not illegal to purchase a fake guitar when you know it is fake. It is illegal to sell a fake guitar without revealing that it is fake. That is called fraud. Selling a fake guitar, or other item, even when you reveal that it is a fake, may be illegal as a trade mark infringement. If you buy an item that you know is counterfeit, then you are aiding and abetting the counterfeiters.
