Originally, they were billed as "less than lethal" munitions. However, they're called "less lethal" now, because it's been discovered that they, in fact, can kill. You have an object moving at a high velocity impacting against the human body - the potential for lethality will always be there, just as the potential for a person to be killed by a Baseball which hits them exists.
