Technically it is legal, however the slaughter of horses is currently not funded , or inspected. Most American horses are too tainted to be eaten safely and anyone selling horse meat to the public should be turned in for safety reasons as it is very likely that the meat was not inspected for safety of consumption. Most horses are treated with certain drugs that never leave the horses body and special care must be taken during slaughter to insure a clean product, otherwise humans and animals can and do get sick and die from eating it. As of late 2012 / early 2013 American horse meat was banned from being shipped to certain areas of Europe as it is not safe to eat.
