Can a landlord hold a tenant responsible for a lease agreement if the tenant was not mentally competent and no attorney was present at the signing of the lease agreement?

Did a court adjudicate the tenant as incompetent? Then, if and when the landlord sues, that would provide the basis for a defense. You can't stop the landlord from trying to recover damages.

You rent a half of a double you've had plumbing issues since we've moved in you moved in Aug 2008 Landlord recently had someone finally come in to fix blocked pipe They kept pulling out tampons He is?

In every state, landlords have a common law duty to provide adequate plumbing. In your case, the plumbing was blocked before you moved in. Accordingly, your landlord cannot hold you responsible for fixing or unblocking the pipes. If your landlord demands that you pay for the blocked pipes or you continue to have plumbing problems, you will need to see a landlord-tenant law attorney or tenant's rights group in your area.

What can you do if your tenant doesn't pay and you can't afford the mortgage for your rental home and are close to foreclose?

Canadian Law can allow the Landlord to waive collecting of rent for as long as they wish, but if the renter is more than 30 days later with their rent then you have the right to tell them to leave and give them 1 months notice before you re-rent the suite or house. Go on www.google.com Type in: Tenants Act in the U.S. (or Canada) You'll see what the laws are. You can also have the police escort the renter out and, after 30 days by Canadian Law you can change the locks and hold the tenants possessions until they cough-up with the rent and if the suite or home is damaged as a Landlord you have the right to hold back the damage deposit as well.
