No you cannot. My husband and I had separated and I was pregnate, the judge would not let us do anything until after I had the baby and had a paternity test done. It sucks, but you do have to wait it out. UNLESS...it is a case of abuse. If he is physically abusive to you and there are reports of the abuse then the judge might take it into consideration. But more than likely, not.
