Fathers should have equal rights with mothers to custody of the children.

Courts are continuing to make progress toward equality and away from the prejudice in favor of Mothers, however it is an uphill battle.

As a Father, it is essential that you know "How to Win." Fathers often approach a Custody Action with a straightforward attitude that as long as I am a great father, I should be entitled to custody.

Just being a great parent is not enough, particularly for fathers. Fathers have to know how to present themselves, What to Say, How to Act, and the Insider Strategies that create the success.

You can Search under "Fathers Winning Custody" or "Win Custody Now" and find lots of great information and ebooks to help you succeed in your quest for custody. Just be certain that the information provided is by an attorney/custody expert.

Apart from all the window dressing suggested above a father should be able to prove to the court that he provided most of the day to day care of the child. That means he was the one who bathed the child and got them ready for bed. He was always the one who took the child to the doctor and dentist visits, stayed home to care for the child when she was sick and attended school conferences and activities. He shopped for clothes, prepared school lunches and spent quality time with the child.

also to mention: My husband of 7 years is going for full custody of his 10 year old daughter. His daughter is currently staying with us since the mother in in jail for drug charges. She is frequently in/out of jail for drug and alcohol charges. His daughter has often complained of domestic violence between mother and boyfriend, drug use in their house and having to move every 4 to 6months. My husband and I have children of our own that are also worried about his daughter since she always asks to live with us. We are going to trial soon and hope to be awarded custody...but sometimes it seems that the court favors the mother. I understand that the child is not old enough to choose for herself on where she would like to reside...so what can we do? Even with all the evidence against the mother...is it likely we could not gain custody? Thanks for any incite.

Although it has been found that the mother is more often favoured by the court system in child custody cases, there is a limit. Your husband simply must prove that his ex wife is an unfit mother as evidenced by her pattern of behaviour. The court must rely on the evidence brought before it in order to make a just determination.

Your husband should hire an attorney if he hasn't done so already. The attorney will gather any police reports regarding any domestic disturbances between the mother and the boyfriend, charge sheets recording any arrests and subsequent convictions on drug charges, and any testimony from child welfare workers who have knowledge of the child's home situation.

The court will also take into consideration the child's preference regarding her living accommodations.

I think this is a slam dunk for your side if you bring in the evidence proving your case!

In Illinois, the court determines child custody based on the best interests of the child, not on factors like infidelity. Both parents have an equal opportunity to seek custody or visitation rights, and the court will consider various factors to determine what is best for the child's well-being.
