It sounds to me like you have issues that go beyond the expertise of anonymous internet posters. Please leave your husband. He's making you miserable. That much is apparent. Of course you know that they don't last! That's why they're called affairs. Whether he was in love with the other woman doesn't really matter. The world "Love" is a big Hollywood misnomer with a strong sexual connotation which doesn't really mean anything. Now if your husband's relationship was for sex as you indicated, I would like to point out to you that a man's sex drive is much stronger than that of a woman. So, what is the asnwer: talk, talk and more talk. Talk, voicing your opinion freely without recrimination is what's cements a marriage. Listen to complaints, voice your own and resolve them. I don't think they can sue you but, they can get affairs and divcores.

However, in addition there can be affairs without sex - emotional affairs still carry intimacy that doesn't necessarily involve physical contact. ANSWER: I don't think so, when it comes to having affairs men will say they are not having affairs because they don't want to loose the friendship of a new woman. It's better to have sex rather than emotionally involved with the other woman. Whether or not sex is not happening yet, yes just by being with another person without the spouse knowing is an affair

Wee what do you think? There is something gravely wrong in that marriage. Anytime one or the other commits adultery against the other, that surely indicates a big problem. The couple needs to seek professional counseling, and soon. Admitting to cheating does not absolve the wrong nor make it right.

I would say it depends on how the two of you kissed. If your French kissing, I would say your treading on very thin ice. Think of it this way, if your kissing someone in a way you would not want your spouse to see, then you can say its cheating. How much do you value your Marriage? Is it really worth it? Where will it lead? How would this hurt your spouse? These are all things to think about. Given the right place the right time and circumstances, and any one us could fall into this. All of us must determine whether the marriage vows we took were worth the words spoken .
