If federal tax refund is subject to garnishment what about this tax rebate?

I remember in 2001 when they last did this type of rebate check, that part of our check was kept as garnishment for student loan payment. So more then likely they can and will keep this rebate check to offset any federal payment that is due. ------------- For offset purposes, the stimulus payment is treated like any other tax refund. This means that part or all of your payment can be used to pay past-due federal or state income taxes or non-tax federal debt such as student loans and child support.

If the court allows a law firm to garnished your state refund for medical bills can they take your Federal refund too?

Yes, they can. The only federal payment not subject to garnishment or lien is Social Security.

Can a debtor file for a garnishment if you are on a payment arrangement?

Creditors usually don't file garnishment unless you miss payments. If you make payments on time there's no reason to file. They have to have a reason before the garnishment can happen.

How do you dispute garnishment in Michigan?

Unless you voluntarily agreed to a garnishment clause in whatever payment contract you signed, garnishment can only be done by means of court action (unless we're talking about the IRS here). In the case of court ordered garnishment you can file an appeal to the garnishment order with the court which issued it.

Can a credit card company garnish your wages even if you pay a minimal payment every month?

The amount of monthly payment is not material to whether or not a consumer gets garnished. Garnishment can only take place after legal action, like a judgment, is granted. Generally a judge sets the amount of the garnishment. Consult an attorney for more specific information. I see no reason why they would go to the litigation process if you are making the minimum payment. Even when a debtor defaults, the process of suing and recovering a judgment is time consuming and expensive, for everyone involved. When a creditor does win a judgment any garnishment order is subject to state and/or federal statutes. The judge can modify the amount depending on the situation. You can find out the garnishment laws of your state by searching "(state name) name)garnishment laws"

Is bankruptcy the only way to stop a garnishment after it has already been filed in Georgia?

You can always pay the balance due. You may be able to enter into a payment agreement that will result in the dissolution of the garnishment, whether a lump sum settlement or a different payment schedule.

How can a mother collect child support better?

If there has been any problem with non-payment the mother should file a motion for contempt and request a court order that the father's employer pay her directly from his wages by means of a garnishment. That way the employer is served with a court order and from then on cuts a check for the amount of the child support payable to the custodial parent and then pays the remaining wages to the obligor in a separate check payable to him.If there has been any problem with non-payment the mother should file a motion for contempt and request a court order that the father's employer pay her directly from his wages by means of a garnishment. Can a credit card garnish your wages in Florida if you are single with no dependents?

Private business cannot garnish your wages. The federal government, state and local government agencies can. Basically, garnishment must be by court order. Thus, the creditor can opt to sue for payment.

How come federal tax refund offset is not on child support payment history?

That is odd. Here in this state Maine it is noted as a child support payment and does go as such on records, when given to the custodial parent for past due child support owed as such a payment to child support and should be a credit towards the child support owed. You need to check with your State Child Support as you did not mention the State you are in. But where it is federal it should be with all states, not just one. But you need to check with the Child Support Enforcement of your state as to why it was not put down as a payment for past due child support and why you were not credited for the amount as of yet. You do have the right to call and ask as the non custodial parent and it is your money that was taken away. So you do have the right to know why.

if you have a wage garnishment can your employer charge you a fee each time they pay a payment on your wage garnishment?

Depending on your state, they might be able to charge a small service fee for doing so, but most businesses likely will not.
