Don't use fake papers if you can possibly help it. It could put your marriage in jeopardy, can make your mate face deportation, and could get you into trouble as well. Do everything as legally as you can. Stop using the fake papers ASAP.
Simple fact, if the documents used are not legitimate, then any legal purpose they are used for will not be legitimate. I am assuming that the issue pertains to a person who is residing illegally in the U.S. which is a federal crime. Therefore anyone with knowledge of and gives assistance to (especially marriage) is aiding and abetting an illegal alien and in violation of several federal crimes, for which they can be prosecuted.

The only way for someone in America that is illegal can get papers is if they are married to someone in America. The person would have to stay married in order to keep the papers.
Absolutely not. You would still be married to your first spouse and your remarriage would be invalid. You cannot be legally remarried while you are still married to your spouse. Papers "about to be signed" are not signed and carry no legal significance whatsoever. You are not divorced until the judge signs the decree and it is entered into the record.
