If a landowner sells lots (or a single parcel) that front on a private road, generally, the law provides the right to each lot owner and their invitees to use the road for access whether or not that right is granted in the deed. Town services such as police, fire and ambulance can also use the road.

However, in some jurisdictions, a private road may also be "dedicated to the public use", meaning the road is open to public use, making it a "public way", at least in the sense that you can drive on it. This is common in forming a new subdivision: the new access road remains private, but the town wants it dedicated to the public use.
