The only one that I am aware of that was fairly recent was the rejection of the right of Washington D.C. residents to elect Senators and Representatives. The court upheld the… 23rd Amendment which allows D.C. residents to only elect electorals for the electoral college (there's a tongue twister!). search a better source this guy is a moron! Lol... The Nasciturus Fiction is a legal fiction. It has to do with courts of law. It basically states that if an unborn child suffers damage then after that child suffers damage and… still has that damage, then the person inflicting that damage is responsible for that damage. Thus, say a man has two children and a pregnant wife and is injured. Then when the baby is born, the nasciturus fiction changes the court decision to make the company that injured the father responsible for supporting 3 children. If someone hits the wife, If the baby is born with an injury, then the person damaging the unborn child is just as responsible as he would be for injuring a child already born.

A: There are probably countless theories on this, but they mostly miss the point. The underlying assumption is that two of the gospels were written by disciples of Jesus and …two of them were written by people so close that they would have known the facts. The truth is that the New Testament gospels were all written anonymously and were not attributed to Matthew, Mark, Luke and John until later in the second century. Modern New Testament scholars say that the gospels could not have been written by eyewitnesses to the events portrayed. They also point to clear evidence that the Gospels of Matthew and Luke were based on Mark, and that John's Gospel was, in turn, loosely based on Luke. Thus we have only one original account - Mark's Gospel, and we do not even know where this author received his information on the empty tomb. We do know that Mark originally ended at verse 16:8 with the young man telling the women that Jesus was risen and they fled in teror, telling no one. Subsequent appearances of the risen Jesus in the 'Long Ending' (verses 16:9-20) do not provide an answer to the empty tomb, because they were added to the Gospel much later. Other, entirely different accounts appear in each of the other gospels, suggesting that pious authors were writing what they believed would convince their readers, not what they believed to be true. Not a theory, but a practical observation by Archbishop Carnley is: "The presence of discrepancies might be a sign of historicity if we had four clearly independent but slightly different versions of the story, if only for the reason that four witnesses are better than one. But, of course, it is now impossible to argue that what we have in the four gospel accounts of the empty tomb are four contemporaneous but independent accounts of the one event. Modern redactional studies of the traditions account for the discrepancies as literary developments at the hand of later redactors of what was originally one report of the empty tomb... There is no suggestion that the tomb was discovered by different witnesses on four different occasions, so it is in fact impossible to argue that the discrepancies were introduced by different witnesses of the one event; rather, they can be explained as four different redactions for apologetic and kerygmatic reasons of a single story originating from one source."
